IP Profile 2007
Intellectual Property in Central Asia / Kazakhstan
"Kazakhstan is likely to implement more stringent IP regulations as it hopes to complete its accession talks with the World Trade Organization (WTO) in 2007. “WTO entry on terms that are beneficial for Kazakhstan is the goal that we must achieve,” Kazakh President Nursultan Nazarbayev told parliament on February 28 2007 during his annual address to the nation.
According to Tolesh Kaudyrov, a partner of Grata, Kaudyrov Intellectual Property, the most actively registered IP objects in Kazakhstan are trademarks and service marks. IP lawyers are expecting changes to the Patent Law to allow patents for innovations.
It remains to be seen if Kazakhstan’s IP regulators can cope with change. “The greatest IP-related challenge in Kazakhstan is meeting deadlines,” says Kaudyrov. “For example, under legislation the term for substantial examination of a trademark application is 12 months, but in practice it takes around 15-17 months.”
"Grata, Kaudyrov Intellectual Property – part of the regional firm Grata Law Firm – has three fee-earners in Almaty. The firm has recently represented clients in the pharmaceutical, publishing, tobacco and software industries. The firm has a roster of big international clients, including Procter & Gamble and Unilever”.
