Almost every company, which works in the area of subsoil use, periodically deals with environmental inspections. For that reason such companies need to know the requirements of legislation and inspection procedure.
Companies can choose the most useful tactic to suit their needs:
firstly, before an inspection to prevent the most common violations (because regulatory authorities usually direct specifically to detection of violations)
secondly, to stand against the violation of their rights and create conditions which will enable them to contest illegal actions of inspectors and protect themselves from unproven legal responsibility and other enforceability measures
GRATA International’s Environmental Law team will be glad to represent your company’s interests during environmental inspections. In particular, our lawyers may assist during inspections, assess legality of state or prosecutor’s actions, provide comments on behalf of the company, make objections, consult company’s employees which participate in the inspection, assess results of inspection and legal consequences thereof for the company, as well as advise whether to appeal results of inspection.
In January 2014, the Environmental Law Department has won the court proceedings for the benefit of a subsoil user. The first-instance court has denied the environmental authority to recover environmental damages caused by dust emissions.
