Service Details

Legal audit of the documents related to labour safety and health (the presence of authorised personnel and local documentation, assessment as to whether the relevant training, instructions and testing (certification/special assessment) have been performed and recorded in due time) and development of the opinion on compliance of the documents audited with the Russian legislation.

The service is relevant mainly to industrial and manufacturing enterprises.

 

Service Relevance

Well-timed and proper assessment of the labour health and safety situation in a company eliminates the risk of bringing to administrative liability for violation of the relevant legal requirements, as well as the need in repeated audits and resulting additional costs of the clients. Chapter 5 of the Administrative Code of Russian Federation provides, inter alia, for the fines to be imposed on both legal entities and their officials, as well as for the suspension of enterprise operations. Proper registration and organisation of the labour safety issues is important in case of accidents and other incidents at an enterprise, which may lead to the liability for violation of the labour safety and health requirements up to criminal sanctions.

From 1 January 2014 the requirement that the employers shall conduct the workplace assessment is replaced with the requirement to arrange the special assessment of working conditions, which applies with respect to the great majority of employees (except for home workers and remote employees). Such an assessment shall be conducted by the employers in cooperation with specialised companies, thus, the employers are advised to check the status of the respective companies' and own employees prior to the assessment. In addition, in some cases, the legislation requires not only scheduled special assessments of working conditions, but also the unscheduled assessment, the need for which may also require an expert opinion.

 

Procedure, Fees and Deadlines

Upon receipt and assessment of scope of HR documents provided by the client, as well as after determination of the number of employees and working conditions, we will determine the timeframe required for the documents processing by GRATA experts and preparation of the opinion with recommendations as to how to bring the documents provided in line with the requirements of the Russian legislation.

The average term for the development of the legal opinion on 'Legal Audit in Terms of Labour Health and Safety' starts from 2 weeks.

The service fee depends on the number of employees, as well as the client's working conditions, and starts from 4,000 US dollars net of VAT and additional costs.

Kazakhstan: New user identification requirements "further regulate social relations"

It has shown a particular interest in  the  Law of 28 December 2017 No. 128-VI on Introducing Amendments and Additions to some Legislative Acts of the Republic of Kazakhstan on Information and Communication ('the Law'), which, among other amendments, requires website operators to collect identification data of website users who post comments on such websites.
