Patents for Inventions, Utility Models and Industrial Designs

In the era of a market economy, especially in the period of the Industrial and Innovation Programme conducted by the Government of Kazakhstan, the relevant issues are the introduction of new technologies, pharmaceuticals and other industrially applicable products. This case requires a guarantee that the author of a new invention, utility model or industrial design will have exclusive rights to the created IP objects.

What does an invention include?

Technical solutions in any area related to a product (device, substance, microorganism strain, cell culture, plants or animals), process (process of operating a material object with material resources), as well as the use of a well-known product or process for a new purpose or a new product for a particular purpose, are protected as inventions. The rights to inventions are protected by a patent or innovation patent.

What does an utility model include?

An utility model includes a constructive implementation of capital goods and consumer goods, as well as their components (a device). For example, a medical mask, a device for the cultivation of microalgae, or a trap for flying insects. The rights to a utility model are protected by a patent.

What is an industrial design?

An industrial design includes the art and design, which determines the appearance of the product. For example, the drawing and texture of fabrics, styles of clothing and footwear, the variety of dishes, and the design of machines and mechanisms. The rights to an industrial design are protected by a patent.

What does a patent allow?

A patent is a protection document confirming your right to an invention, utility model or industrial design, and has effect only in the territory of the country where it was issued.

In addition, the patented invention, utility model or industrial design is your property (Article 115 of the Civil Code of the RK), an intangible asset. A patent allows you to dispose of registered inventions, utility models or industrial designs, as well as any other property, for example to sell, donate, pledge, or grant the right of use to other parties.
