Given
the requirements of the Labour Code of the Republic of Kazakhstan,
other regulatory legal acts that regulate the HSE issues, GRATA Law

An important condition of doing business in Kazakhstan is the observance of requirements of the legislation in the area of HSE.
In particular, pursuant to Article 317 of the Labour Code of the Republic of Kazakhstan, the employer shall be obliged to: - take
steps to prevent from any risks at working places and provide in the
process by preventive measures, replacing of production equipments and
process flows with the most safety ones;
- instruct and train employees on the safety and labour protection;
- perform organisational and technical activities on labour safety and protection;
- instruct employees, provide the employees with corresponding instructive documents on safe work performance;
- check
knowledge of employees on labor safety and protection, check knowledge
of managers and specialists according to the regulations approved by an
authorised state labour agency;
- create for employees required
hygiene-and-sanitary conditions, ensure the delivery and repair of
overalls and safety shoes, provide employees with the preventive
treatment means, washing and anti-infective agents, first-aid kit,
milk, medicinal and protective food in accordance with the standards
established by an authorised state labour agency;
- upon the
written request provide an authorised state labour agency and its
territorial division, officials of the health inspection service, the
representatives of employees with necessary information on safety
status, labor conditions and protection in the company;
- comply with the instructions of the state labour inspectors;
- register, account and analyse accidents and occupational deceases;
- at
least once every five years perform with the representatives of
employees the periodical certification of production facilities in
terms of the labour conditions status, as well as obligatory
certification after re-construction, improvement, new equipment or
technique installation in accordance with the regulations approved by
an authorised state labour agency;
- ensure the investigation of industrial accidents in the procedure specified by the legislation of the Republic of Kazakhstan;
- insure the liability for any damage to the health and life of the employees during performance of their duties.
- inform
on the acute intoxication event to the relevant territorial subdivision
of an authorised state agency in the area of sanitary and
epidemiological welfare of the population;
- ensure the safe working conditions;
- at
its own expense conduct obligatory, periodical medical examinations and
pre-shift medical examination of employees, in case specified by the
legislation of the Republic of Kazakhstan as well as in case of the
transfer to another job with the changes in working conditions, or in
case of occupational disease signs;
- take immediate actions to prevent from emergency situation and impact of injuring factor on other persons.
