New Labour Code – New Labour Agreement

As of 22 May 2007, the new Labour Code
came into effect in the territory of the Republic of Kazakhstan,
replacing the previous law of the Republic of Kazakhstan, "On Labour in
the Republic of Kazakhstan" which had regulated labour relationships in
the territory of the Republic of Kazakhstan for the last seven years.
In
addition to the law of the Republic of Kazakhstan "On Labour in the
Republic of Kazakhstan" the following acts of the Republic of
Kazakhstan has now been recognized as invalid: - The law of the Republic of Kazakhstan, "On Collective Agreements" dated July 4, 1992;
- The law of the Republic of Kazakhstan, "On Collective Labour Disputes and Strikes" dated July 8, 1996;
- The
law of the Republic of Kazakhstan, "On Introduction into Effect of the
Law of the Republic of Kazakhstan "On Labour in the Republic
Kazakhstan" dated December 10, 1999;
- The law of the Republic of Kazakhstan, "On Social Partnership in the Republic of Kazakhstan" dated December 18, 2000;
- The law of the Republic of Kazakhstan, "On Industrial Safety and the Protection of Labour" dated February 28, 2004;
- The
decree of the Supreme Court of the Republic of Kazakhstan, "On
Introduction into Effect of the Law of the Republic of Kazakhstan "On
Collective Agreements" dated July 4, 1992.
It is vitally
important for your company to bring previously concluded individual
employment agreements into compliance with the new Labour Code of the
Republic of Kazakhstan as well as to conclude all future employment
agreements in accordance with the Code.
