Employment Policies and Procedures

The
current labor legislation of the Republic of Kazakhstan has the range
of requirements to availability and content of the documents to be
applied by employers when executing labor relations with employees. One
of those documents is the Employment policies and procedures.
WHEREBY Employment policies and procedures are OBLIGATORY for an employer.
Employment
policies and procedures (“EPP”) are the basic act of an employer
regulating the procedure of relations between an employer and employees
as well as between employees themselves.
The EPP shall be
approved by an employer as agreed with representatives of employees.
Coordination shall be in the procedure specified by Article 12 of the
Labor Code of the Republic of Kazakhstan.
Pursuant to Article 69 of the Labor Code of the RK the EPP shall be obligatory both for employer and employees.
According
to Article 33 of the Labor Code of the RK an employer shall be obliged
to introduce the EPP to an employee when employing.
Practical importance of the Employment polices and procedures.
The
presence of this document has been dictated not only by the imperative
provisions of the Labor Code of the RK but first of all by the
operational need. Labor relations experience shows that the clearer and
more detailed the rules for relations between an employer and employees
are specified, the more organized the company’s operations are and the
easier the decisions making is in case of conflicts between employees
and an employer. Considering that the EPP may include:
- Employment procedure/procedure for labor agreement termination;
- Basic rights (obligations) of employees/employers;
- Working ours and timekeeping;
- Corporate culture (business ethic) principles of a company;
- Basic commercial and informational safety;
- Responsibility for violation of labor discipline;
- Bonus system.
