Government established control over compliance of food, feeds, animal by-products, and health and welfare of animals with legal requirements

On the 4 April 2018, the Law of Ukraine “On State Control over Compliance of Food, Feeds, Animal By-products, and Health and Welfare of Animals with Legal Requirements” dated 18 May 2017, № 2042-VIII (hereinafter referred to as “the Act”) came into force[1].

The Act strengths the state control over the activity of market operators engaged in the production and/or circulation of food products and other objects of sanitary supervision, and/or feeds.

The creation of competent body in the sphere of state control has been announced. By 1 January 2021, the Competent Body has the right to authorize laboratories to conduct laboratory tests to detect trichinosis for the purposes of state control.

The Act provides for both annually scheduled inspections and unplanned examinations in case of arousal of a reasonable suspicion of non-compliance with the Act.

Within 5 years after the date of publication of the Act, goods that are imported to the customs territory of Ukraine are subject to documentary audit, compliance checks, and physical inspections at checkpoints across the state border of Ukraine or customs control zones on the customs duty of Ukraine.
