Subsoil users must assess the impact of subsoil use on the environment

The Cabinet of Ministers of Ukraine ordered subsoil users to report the results of environmental impact assessments or their intention to conduct such an assessment to the Unified Environmental Impact Assessment Register. The transition period ends on 18 June 2018.

According to the Resolution of the Cabinet of Ministers № 277 dated 6 April 2016[1], the fee for renewal of special permits for the use of subsoil use and the fee for introduction of changes into the special permits regarding the increase of mineral resources production will not be charged.

Also, the Resolution regulated the procedure for holding auctions for the sale of permits for the use of the land, and the procedure for issuing permits without conduction of an auction. In addition, the Resolution suppresses certain corruption practices of “delaying” of the issuance of permits: the permit is considered to be agreed if the state authorities do not give a positive or negative answer within 90 calendar days after receiving the application.

Besides, special conditions of the permit must include a provision concerning mandatory environmental impact assessment within 6 months after the issuance of the special permit to the subsoil user.
