The following terms and definitions are used in the Privacy Policy:

"GRATA International Association" (hereinafter “GRATA International”) - a global network of independent law firms (hereinafter “member”), providing legal services under the single brand of GRATA International or GRATA.

"Personal Data" - information relating to a certain subject or a subject determined on the basis of such personal data, recorded on electronic, paper and(or) other material media. In particular, the Personal Data includes: name, identification number, place of residence or location, online identifier, e-mail address, telephone number, including mobile phone number, address and other data of the subject of personal data;

"Subject" - an individual, to which the personal data belongs;

"Company" - a sole trader, legal entity, state or government agency that engages with GRATA International, including a client to whom GRATA International provides or can provide services;

"Company Related Party" - an individual who is the founder (participant) of the Company, its employee, or a person hired by or serving the company under a civil law contract, as well as another person that the Company interacts or may interact with;

"Personal Data Collection" - actions aimed at obtaining personal data;

"Personal Data Processing" actions aimed at the accumulation, recording, systematisation, structuring, storage, modification, amendment, use, review, distribution and other transfer, depersonalisation, restoration, grouping or combining, blocking and destruction of personal data;

"Applicable Law" - the law applicable on the territory of the state, where the Personal Data is collected and/or processed.

GRATA International may collect Personal Data from the following sources:

  • Entities that provide their Personal Data to GRATA International representatives in oral form, in paper documents, in electronic documents, electronic messages, in feedback forms published on the official website of GRATA International (www.gratanet.com), in other ways, directly or through their representatives; 
  • Representatives of the companies that provide Personal Data of the company related subjects to GRATA International representatives in oral form, in paper documents, in electronic documents, electronic messages, in feedback forms published on the official website of GRATA International (www.gratanet.com), or in other ways; 
  • Tracking the subjects' activity on the Internet using cookies; 
  • Public sources; 
  • State information systems according to the procedure and under the conditions provided for by the Applicable Law.

 

GRATA International collects and processes Personal Data related to certain subjects for the following purposes:

  • to provide a Company, which the subjects are related to, with the information about GRATA International services and the terms of their provision, including business offers, invitations to seminars and other events organised with the participation of GRATA International; 
  • to provide a Company, which the subjects are related to, with information about any changes and trends in the legislation and application thereof, as well as with articles, reviews and other informational and/or analytical materials in the area of law that in GRATA International's opinion can be of the Company's interest; 
  • to provide a Company, which the subjects are related to, with other information related to the activities of GRATA International, as well as with any other information that in GRATA International's opinion can be of the Company's interest; 
  • to provide services to the Company or Company Related Party; 
  • to negotiate with the Company (Company Related Party) in relation to services provided by GRATA International to the Company (Company Related Party) or to any other type of cooperation with the Company (Company Related Party); 
  • to improve the quality of services provided by GRATA International to the Company and/or Company Related Subjects; 
  • for the purposes established by the Applicable Law, in particular where the personal data collection and processing is required for the performance by members of  their duties under the Applicable Law, performance by law enforcement agencies, courts, and for enforcement proceedings, including protection of rights and legitimate interests of members.


Personal Data collection and processing are allowed without the consent of the Subject if they are required:

  • to perform a contract concluded between the Subject and the member, or if the member, at the Subject's request, takes the measures necessary to conclude the contract; 
  • to perform  GRATA International’s obligations under the law; 
  • to protect the essential interests of the Subject or another individual; 
  • to protect the rights or legitimate interests of GRATA International or another person, including with the assistance of law enforcement agencies, courts and bailiffs. 
  • in other cases established by the Applicable Law.

In cases where the Persona Data collection and processing without the consent of the Subject are allowed by the Applicable Law, the Subject may at any time request the suspension of such collection and processing until GRATA International demonstrates the legitimacy of interests for which protection the Personal Data are collected and processed.

Personal Data collection and processing using automation tools are allowed.

 

Personal Data transfer

Personal Data received by one of the individuals or legal entities, branches, representative offices being a part of GRATA International, can be freely transferred to another individual or legal entity, branch, representative office being a part of GRATA International and located in any state, for processing in accordance with this Privacy Policy.

Personal Data received by one of the individuals or legal entities, branches, representative offices being a part of GRATA International, can be transferred to another person or government agency for processing in accordance with the Applicable Law and this Privacy Policy on the territory of any state.

The Subject may request copies of regulatory legal acts, corporate rules and other acts on the Personal Data protection in the country of interest, where GRATA International can transfer the Personal Data to, by sending the request to info@gratanet.com.


Cross-border Personal Data transfer

GRATA International may transfer Personal Data to the territory of other states according to a court judgement or arbitral award, as well as any decision of the administrative authority of a third country, and/or an international organisation, if (1) such decision is binding for GRATA International in accordance with the Applicable Law, including applicable international treaties, or (2) such transfer is permitted by the Applicable Law and is subject to the statutory requirements.

GRATA International may perform the cross-border transfer of Personal Data for the purposes listed in Clause 3 of this Policy, and in the following cases:

  • If the Personal Data transfer is required to perform the contract at the Subject's request or pre-contract measures, as well as to conclude or perform a contract in the interests of the Subject;
  • If the Personal Data transfer is required to file a statement of claim or statement of defense in the interests of the Subject;
  • If the transfer is required to protect the vital interests of the Subject, when the Subject physically or legally cannot give its consent;
  • The Personal Data can be transferred from an open register of the European Union designed to provide information to an unlimited number of persons, but only subject to the conditions established by the European Union law.

 

GRATA International may perform the cross-border transfer of Personal Data for other purposes and in other cases with the consent of the Subject obtained upon notifying him/her on the possible risks associated with such transfer.

 

Personal Data storage

Personal Data collected by GRATA International in accordance with this Policy shall be stored and processed within the period, during which GRATA International pursues the purposes, for which the Personal Data has been collected.


GRATA International or persons providing Personal Data storage services to GRATA International shall store Personal Data during the period required for the Personal Data Processing, in accordance with this Privacy Policy.

Rights of the Subject of Personal Data

The Subject has the right at any time to withdraw his/her consent to the collection and/or processing of his/her Personal Data, having informed thereof by e-mail: info@gratanet.com.  Such consent withdrawal does not entail the illegality of the Personal Data Processing held prior to the receipt of such withdrawal by GRATA International.

The Subject has the right to demand from GRATA International an access to his/her Personal Data collected in accordance with this Privacy Policy, to remove his/her Personal Data, to restrict the use thereof, to object to the use thereof, and to require the transfer of the Personal Data to other subjects for processing. To exercise this right, the Subject can contact GRATA International by info@gratanet.com. Thereat, the exercise of this right shall not violate the rights and legitimate interests of other people.

The Subject has the right to appeal against GRATA International's actions or omissions to public authorities in the procedure established by the Applicable Law, including the Supervisory Authority established on the territory of the European Union to the extent permitted by the Applicable Law.

 

Confidential information 

We ask you not to send us and not to transfer  to us any kind of confidential personal information, such as information relared to racial or ethnic background, political views, religious or any other beliefs, medical, genetic or biometrical data, criminal background or trade union membership).

 

Protection of Personal Data of underage persons

By using services and tools of GRATA International members, you confirm that you are aged 16 or over.

We respect the privacy of children and do not collect, use or disclose personal information of children under 16 without their parent’s or guardian’s consent. 

If we become aware that information, provided to or collected by GRATA International, is in a fact personal information of children, which was collected without consent of one of the parents or guardians, we will take immediate measures to destroy such information. 

GRATA International is not liable for damages caused to the Subject as a result of the Personal Data processing, if such processing did not violate the requirements of the Applicable Law, and if the damage was cased by the processing actions performed at the Subject's direction.

Changes to Privacy Policy

This Privacy Policy is effective from the moment of its publication on the official web-site of GRATA International (www.gratanet.com), and all previous versions of this Privacy Policy are invalid from the moment of this publication. Any future changes made to Privacy Policy will be published and available on our web-site www.gratanet.com.

GRATA International carefully handles the Personal Data collected in accordance with this Policy and makes every effort and takes measures to protect them and ensure security in accordance with the requirements of the Applicable Law.
