Procedure, provisions and amount of guarantee fees and collateral provided by employees for the labour force imported to the Republic of Kazakhstan

   

For the purposes of this Article the following terms are used:

Employer — a legal entity or an individual as well as a subsidiary or permanent mission of a legal entity, which an employee is in employment relationship with.

Permit for the attraction of a foreign labour force (Permit) — a document defining the amount of foreign labour force attracted to the Republic of Kazakhstan issued by the Ministry of Labour and Social Security of the Population to an employer as well as special provisions of its use.

The list of a foreign labour force attracted — an attachment to the Permit, with data concerning foreign labour force attracted. The Permit is considered invalid without the list of foreign labour force certified by an authorised body on employment issues.

In compliance with the Rules of determining quota and issuing of permits to employers for the attraction of foreign labour force to the Republic of Kazakhstan, approved by the Decree of the Government of the Republic of Kazakhstan No. 836 as of June 19, 2001, an Employer shall deliver foreign labour force attracted to the place of permanent residence after the expiration of the Permit's validity.

In this connection an Employer shall make a deposit on savings accounts of one of banks of the Republic of Kazakhstan to his/her name as a guarantee to deliver foreign labour force to the country of permanent residence. Such deposits are called as «guarantee fees and collateral» in the legislation. Additionally, interests paid by banks out of guarantee fees and collateral will be the property of an Employer.

An Employer shall make a guarantee fee and provide collateral when the Ministry of Labour and Social Social Security of the Population takes a decision to issue a Permit.

An authorised body on employment issues determines the amount of guarantee fee and collateral through summing up the cost of return ticket to the nearest airport or railway station of foreign citizen's country of residence and per diem expenses en route. The amount of per diem expenses equals to 50 (fifty) percent of the monthly calculation index (for 2002 the monthly calculation index is 823 tenges). As this amount is quite small given 2 to 3 days en route, and is equal to 6 to 8 US dollars; the amount of air ticket or pasteboard is mainly taken into consideration.

Given the calculations of an authorised body on employment issues, an Employer shall make deposits on his own, to bank for the period of validity of Permit issued in the national or foreign currency. The authorised body on employment issues is responsible for the correctness of calculations of guarantee fee and collateral.

A need in guarantee fees and collateral is caused by the fact that visa support for attracted foreign employees is made only in case an Employer has a list of attracted foreign labour force certified by the authorised body on employment issues. The list is certified upon submission of the following:

  • copies of bank deposit contract;
  • a certificate of bank confirming cash transfer to an account, indicating the purpose of deposit and surnames, names of persons to receive deposit amounts.

Upon expiration of the Permit validity or in case of cancellation of an individual labour contract by an Employer with a foreign citizen, the guarantee fee and collateral may be withdrawn from bank account upon the written consent of the Ministry of Labour and Social Protection of Population.

To obtain a written consent of the Ministry of Labour and Social Protection of Population of the Republic of Kazakhstan and withdraw the guarantee fee and collateral, an Employer shall submit to the Ministry of Labour and Social Protection of Population of the Republic of Kazakhstan the following:

  • a copy of Permit;
  • an application indicating exact address of the bank, where the guarantee fee and collateral have been made, bank account number, account number, amount of guarantee fee and collateral;
  • copies of passports of foreign specialists with the stamp of frontier service bodies indicating departure from the territory of the Republic of Kazakhstan or copies of air or railway tickets.
