The issues connected with the procedure of contractors license reregistration are regulated by following legal acts of the Republic of Kazakhstan.
- Law of the Republic of Kazakhstan About Licensing dated April 17, 1995 No2200 (hereinafter Law about licensing);
- Resolution of the Government of the Republic of Kazakhstan About confirmation of rates of license duty for the right on separate kinds of activity business dated January 24, 2002 No100 (hereinafter Resolution No100).
1. Common conditions
In accordance with Article 2 of Law about licensing license is considered issued by competent state body permission to the citizen or legal entity on occupation of definite kind of activity or on performing of definite actions.
The license is issued only to the subject which has qualification level corresponding to the qualifying standards fro definite kind of activity.
On issuing of the license the conditions of production, providing safety of society, environment, human life and health as well as guarantee of quality of the production, works and service, are taken into account.
2. Cases of license reregistration
License shall be reregistered in the following cases:
- Changing of name of the legal entity;
- Changing of the organization legal form of the legal entity, except of the cases providing by legal acts of the Republic of Kazakhstan;
- Changing of the address of the legal entity (if it indicates in the license).
3. Procedure of reregistration of the license
In the case of arising of above mentioned the legal entity is obliged to submit the application on license reregistration with corresponding documents attachment, confirming the indicated data within one (1) month.
Licensor shall reregister the license within ten (10) days from the submitting by the licensee of corresponding written application.
On the license reregistration license due for the right on occupation of separate kind of activity is paid in the order and amount provided by the tax legislation of the republic of Kazakhstan. In accordance with Section 3 of the Resolution No 100 rate for license reregistration is ten (10%) per cent from the rate of the license due on the license issue but not more than four (4) month settled indexes.
According to the Resolution No 100 the following rates on license issue are indicated:
- Projection, construction and exploitation of the industrial dangerously explosive and fire risk and mining manufactures, electric network and substation, hydro engineering building, trunk gas and oil produce piping, working under the pressure and drilling works on oil and gas — 10 month settled indexes;
- Projection, production, montage and repair of chemical, drilling, oil and gas producer, geological survey, mining, metallurgical, energetic equipment, apparatus and system of the control, anti-damage safety and signaling, lifting building as well as boilers, vessels and pipelines working under the pressure — 10 month settled indexes.
On 2004 one (1) month settled index established in amount of 919 tenge.
In accordance with the valid legislation in the case of amending of the Subsoil contracts the license on subsoil are not reregistered.
