One of the principal elements of the foreign and national investors' protection is the right to legal defense, including arbitrage. The existence of arbitration tribunals is a generally recognized guarantee for foreign investors in a civilized world. Currently, some 15 arbitration tribunals operate in Kazakhstan.

At present Kazakhstan is a full participant of the following international treaties:

1. The UN Convention on the Recognition and Enforcement of Foreign Arbitral Awards of 1958 («The 1958 New York Convention»).
2. Convention on the Settlement of Investment Disputes between States and Nationals of Other States of 1965 («The 1965 Washington Convention»).
3. European Convention on International Commercial Arbitration of 1961 («The 1961 Geneva Convention»).
